Freight Forwarding Terms and Conditions

Welcome to EM International Freight. By requesting a quote or booking a shipment, you agree to the following terms. These conditions govern our relationship as an NVOCC (FMC Org 035119) and your responsibilities as a shipper.

1. Scope of Services

EM International Freight LLC operates as a licensed Non-Vessel Operating Common Carrier and freight forwarder. Consequently, we arrange transportation through third-party carriers (vessels, aircraft, or trucks). While we ensure 100% focus on safe delivery, our role is that of a logistics coordinator.

2. Quotations and Rates

All quotes are based on the information provided (weight, dimensions, and type of cargo).

  • Validity: Rates are subject to change based on carrier availability and fuel surcharges. 
  • Exclusions: Unless specified, quotes do not include duties, taxes, or unexpected customs inspections.

3. Carrier Liability and Insurance

As an NVOCC, we issue our own House Bill of Lading (HBL). However, our liability is limited by international conventions (such as COGSA). Therefore, we strongly recommend that all exporters and importers secure comprehensive cargo insurance for every shipment.

4. Payment and Documentation

Payments are due upon receipt of the invoice unless otherwise agreed in writing.

  • Accuracy: Shippers must provide accurate documentation for customs nationalization. 
  • Delays: We are not responsible for delays caused by government hold-ups or incomplete paperwork provided by the client.

5. Tracking and Portal Use

Customers are responsible for maintaining the security of their login credentials for our tracking portal (https://emfreight.app.shipthis.co/session/signin).

6. Governing Law

These terms are governed by the laws of the State of Florida, USA. Any disputes shall be resolved in the courts of Miami-Dade County.
